The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 120B and 34 of the Indian Penal Code.

As per the prosecution case, the husband of the informant who had gone to the place of her sister's daughter was found killed.

It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The petitioner was falsely implicated in the case in course of investigation. It is submitted that there are no eye witness to the occurrence and the petitioner has no reason to commit the alleged crime. The allegation of recovery of rope etc. are false and concocted only

Patna High Court CR. MISC. No.46785 of 2021(3) dt.08-03-2022 2/2 to falsely implicate the petitioner. The petitioner is in custody since 14.10.2020 and has no criminal antecedent. Chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation, the petitioner being in custody for 1 year 4 months and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Punpun P.S. Case no. 225 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge, Masaurhi, District Patna.
