2. Heard learned counsel for the petitioner and learned A.P.P. for the State.

3. The petitioner seeks regular bail in connection with Nirmali P.S. Case No. 10 of 2023 registered on 23.01.2023 lodged under Sections 25(1-b)(a)/26 of the Arms Act.

4. As per the prosecution case, two countrymade pistols has been recovered from the possession of the petitioner.

5. Counsel for the petitioner submits that without live cartridges, only recovery of pistols is of no use.

6. Counsel further submits that petitioner is innocent and has committed no offence. He submits that petitioner is in custody since 24.01.2023 having clean antecedent. He further

7. Learned counsel for the State opposes the prayer for bail and submits that the said recovery of pistols has been made from the possession of the petitioner.

8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned J.M., Birpur, Supaul in connection with Nirmali P.S. Case No. 10 of 2023, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

9. With this observation, the bail application stands allowed.
