Petitioner is accused in connection with Sahebganj P.S. Case No. 142 of 2014 registered under Sections 147, 149, 341, 323, 353, 307, 427, 504 and 188 of the I.P.C. The prosecution case is that the Police on receiving secret information about preparing the illicit liquor and selling the same by the petitioner reached at the house of the petitioner and asked license then the petitioner and others started scuffling with police personnel and also attempt to cause injury and damaged the police vehicle.

Learned counsel appearing on behalf of the petitioner submits that no any specific overt act has been alleged against the

Patna High Court Cr.Misc. No.56244 of 2015 (2) dt.15-12-2015 2/2 petitioner, who is named in the F.I.R. along with others, nor any police personnel has sustained injury. It is also submitted that petitioner has no criminal antecedent and is in custody since 20.09.2015.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M., (West) Muzaffarpur in connection with Sahebganj P.S. Case No. 142 of 2014.
