JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 420 and other sections of Indian Penal Code.

As per FIR, petitioner is alleged to have obtained appointment to the post of Special Survey Amin on the basis of forged and fabricated documents.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case and after petitioner was appointed to the post of Special Survey Amin by the competent authority after proper verification. Moreover, petitioner has already been terminated from the service. It is further submitted that similarly situated co-accused persons have been granted bail vide order passed in

Patna High Court CR. MISC. No.38199 of 2022(2) dt.22-11-2022 2/2 Cr. Misc. No. 26368 dated 20.09.2022 by this Hon'ble Court. Petitioner has got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Jehanabad in Jehanabad P. S. Case No. 43 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
