JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner and six others are named in the first information report on the omnibus allegation that they assaulted the informant with fists and slaps causing her miscarriage. Learned counsel appearing for the petitioner submits that earlier petitioner came before this court for seeking anticipatory bail and a co-ordinate Bench of this court vide order dated 01.07.2015 passed in Cr. Misc. No. 25997 of 2015 directed the petitioner to surrender before the court below within six weeks from the aforesaid date for regular bail but unfortunately, the aforesaid order could not be communicated to the petitioner in time as a result whereof, petitioner could not surrender before the

Patna High Court Cr.Misc. No.56939 of 2015 (2) dt.17-12-2015 2/2 court below within the above stated stipulated period. It is further contended by him that while disposing of the anticipatory bail petition of the petitioner, a co-ordinate Bench of this court observed that only two superficial injuries were found on the person of the informant and moreover, the parties have already compromised the case though the offence is not compoundable in nature.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Judicial Magistrate 1st Class, Jhanjharpur, Madhubani in connection with Bheja P.S. Case No. 52 of 2014. (Hemant Kumar Srivastava, J) SHAHZAD/- U T
