The petitioner is in custody in connection with Saharsa Mahila P.S. Case No. 34 of 2014 for offence punishable under Sections 448, 341, 323, 376, 511, 504, 379 and 506/34 of the Indian Penal Code.

The petitioner has been charged of attempting rape on the informant.

Learned counsel for the petitioner has submitted that the allegation is concocted and even earlier similar allegation had been made against others which ended in a compromise. For the purpose, Mr. Amarnath Jha, counsel for the petitioner refers to an order present at Anneuxre-3. He submits that the petitioner has a clean antecedent and a bare perusal of the FIR would show that not only the petitioner but his entire family have been roped in the present case.
