Petitioner nos. 1 and 3 being co-villagers and petitioner no.2 being grand-father of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 323, 354, 498A, 34 of the Indian Penal Code.

Basic accusation is of torture, making assault and administering poison to the informant.

It is submitted by learned counsel for the petitioner that thrust of accusation is against the husband of the complainant. Petitioner nos.1 and 3 being co-villager of the husband of the

Patna High Court Cr.Misc. No.8324 of 2016 (2) dt.19-02-2016 2/2 complainant, hence, they have been maliciously named in the FIR and petitioner no.2 is grand-father of the husband of the complainant and is 80 years old.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhepura in connection with Complaint Case No.489/2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
