JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Balia Belon P.S. No. 15 of 2019, registered for the offences punishable under Sections 341, 323, 379, 504, 498A/34, of the Indian Penal Code and Section 3 /4 of Dowry Prohibition Act.

This case is under Section 498A of the I.P.C. and on appearance of the opposite party No. 2, the matter was referred to the Patna High Court Mediation & Reconciliation Center, vide order dated 21.08.2019. The report of Mediator is available on record at Flag "Q". From perusal of the report it appears that matter has been settled and Rs. 1,00,000/- has already been received by the complainant and rest amount will be paid after

Patna High Court CR. MISC. No.34452 of 2019(6) dt.25-10-2019 2/2 Chhat Puja on 06.11.2019.

Both parties have admitted the above facts.

In view of the above as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned lower Court on 13.11.2019 and on that day O.P. No. 2 shall appear in person in the Court and petitioner have to handover the rest amount to the O.P. No. 2. Once being satisfied by the above facts, learned lower Court be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of the learned S.D.J.M. Katihar, in connection with Balia Belon P.S. Case No. 15 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned otherwise petitioner has to pray for regular bail.
