Petitioner in the present case is seeking anticipatory bail in connection with Barharia P.S. Case No. 297 of 2018 registered for the offences punishable under Sections 147, 447, 341, 323, 307, 324, 325, 379, 506 and 504 of the Indian Penal Code.
Learned counsel for the petitioner submits that so far as this petitioner is concerned, there is no specific allegation of causing any assault against her. It is further submitted that the petitioner has no criminal antecedent. It is further submitted that the two accused persons have been granted privilege of anticipatory bail by a learned coordinate Bench of this Court vide Annexure-4 to the writ application.
Patna High Court CR. MISC. No.36532 of 2019(2) dt.12-06-2019 2/2 Learned APP for the State is present and has opposed the prayer for anticipatory bail.
Considering the facts and circumstances of the case particularly that there is no specific allegation of assault against this petitioner and further that she has no criminal antecedent, let in case of arrest or surrender of the petitioner within a period of four weeks from today, the abovenamed petitioner be enlarged on bail on furnishing bail bond of Rs.15,000/- (rupees fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Barharia P.S. Case No. 297 of 2018, subject to the condition prescribed under Section 438(2) of the Cr.P.C. (Rajeev Ranjan Prasad, J) arvind/- U T
