The petitioner is accused in connection with Doriganj P.S. Case No. 290 of 2018 registered under sections 413 and 414 of the I.P.C. pending in the Court of A.C.J.M.-VII, Saran at Chapra.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. Petitioner is in custody since 12.02.2019. Nothing has been recovered from the conscious possession of the petitioner.

Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner by contending that there is allegation of purchase and sale of the stolen motorcycle against

Patna High Court CR. MISC. No.36120 of 2019(3) dt.02-09-2019 2/2 the petitioner. Four stolen motorcycles have been recovered from the possession of the petitioner but he did not show relevant paper of the vehicles.

Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.

However, liberty is give to the petitioner to renew his prayer for bail after framing of charge.
