JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Sonpur RPF P.S. Case No. 02 of 2020 registered for the offence punishable under Section 3RP (UP) Act.

The petitioner is in custody since 21.07.2020. According to the case of the prosecution on search two 1.5 meter long cables and 11 pendrole clips were recovered by the RPF personnel from the petitioner's possession. The petitioner is said to have disclosed that the articles were stolen by him, which were railway property.

Learned counsel appearing on behalf of the petitioner has submitted that since officials of the RPF are the witnesses,

Patna High Court CR. MISC. No.35810 of 2020(3) dt.27-01-2021 2/2 there is no chance of him tampering with the evidence and influencing the prosecution's witnesses, if allowed regular bail. Considering the nature of accusation and period of his custody, this application is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. (Railway) Sonpur (Saran) in Sonpur RPF P.S. Case No. 02 of 2020.
