JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2019 This application, for grant of anticipatory bail, arises out of Teghra P.S. Case No. 106 of 2019, disclosing offences under Sections 30(a) of the Bihar Prohibition of Excise Act, 2016.
Prosecution case is that the informant on the information that petitioner and his son are engaged in liquor trade and have kept the wine on their old house, went along with the police and raided the old house of the petitioner and recovered 46.875 litres of liquor.
Submission of learned counsel for the petitioner is that for the same office, petitioner and his son both have been made accused. Further submission is that petitioner has no criminal antecedent and he is aged about 70 years and from the
Patna High Court CR. MISC. No.34332 of 2019(3) dt.19-08-2019 2/2 F.I.R., it is evident that the recovery has been made from the abandoned house of the petitioner. Further submission is that the co-accused, who is son of the petitioner has already surrendered in this case.
Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the materials available on record, if possible on same day, without being prejudiced by this order.
