The petitioner seeks bail in connection with Dulhin Bazar P. S. Case No.24 of 2021, instituted for the offences under Sections 341, 323, 307, 379, 504/ 34 of the Indian Penal Code and later on, Section 302 of the I.P.C. was also added. The learned counsel for the petitioner submits that the petitioner is in custody since 19.01.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

The learned counsel for the petitioner further submits that the informant alleges that the named accused persons including the petitioner came to his house and started assaulting Bhukhmari Khatoon, Khursheed Ansari and Md. Gaffar Ansari,

Patna High Court CR. MISC. No.47589 of 2021(3) dt.21-03-2022 2/3 who were injured and taken to hospital. One of the injured Khursheed Ansari was referred to P.M.C.H. for better treatment. The learned counsel for the petitioner submits that from bare perusal of the allegation as alleged in the F.I.R., it would manifest that the occurrence took place on account of quarrel between the children. It is further submitted that in the occurrence, both sides were injured and as far as allegation of assault is concerned, the same is general and omnibus in nature. It is further submitted that the petitioner is a young boy of 20 years and is a person with clean antecedent and keeping him in custody would jeopardize his entire career.

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent, charge-sheet has been submitted in this case and taking into consideration the submissions made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Danapur, Patna in connection with Dulhin Bazar P. S. Case No.24 of 2021.
