During pendency of the writ application substantial payment has been made to the petitioner on account of Gratuity, ACP, MACP and some other admitted amount.

Learned counsel for the petitioner admits those payments, however, by filing a rejoinder the petitioner has raised a grievance in the following terms:

"6. That it is further mention that the following amounts have not been paid by respondent no. 4, 5 and 6 (J.P. University)- i. Gratuity Ten Lakh paid amount 4,26,657.00 ii. Claim of difference of pay D.A. and others from March 1989 to October 1992.

v. Detail calculation chart."

In course of argument learned counsel for the petitioner agrees that he will be satisfied if an opportunity is given to the petitioner to represent his grievance before the Registrar, J.P. University (respondent no.

5) within a period of eight weeks from today and the same be considered and disposed of by respondent no. 5 within a reasonable period. Mr. Nagendra Kumar Singh, learned counsel representing the University submits that if such a representation is filed the same will be considered.

In the given facts and circumstances of the case this writ application is being disposed of with liberty to the petitioner to raise his grievance with regard to the claims made in paragraph '6' of the rejoinder within eight weeks before respondent no. 5 who will look into the same and shall consider the claims within a period of three months from the date of receipt of the same.

If the claim is admitted either in full or in part, the admitted payment shall be made within one months after disposal of the same. However, in case the claims are denied, respondent no. 5 shall inform the petitioner with reasons thereof within said three months from the date of submission of the representation.
