2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 420, 406/34 of the Indian Penal Code.
3. It is submitted on behalf of the petitioner that son of petitioner has already been granted pre-arrest bail in connection with the present FIR by this Court vide order dated 13.12.2022, passed in Cr.Mis.No. 48489/2022 (annexure 2 to the bail petition) with condition that he shall refund the money to the informant within the stipulated time period. Petitioner claim clean antecedent.
4. Learned counsel for the State and the informant
Patna High Court CR. MISC. No.34581 of 2025(3) dt.05-12-2025 2/2 oppose the prayer for pre-arrest bail.
5. Considering the aforesaid facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in Chandauti Police Station Case No. 89 of 2022, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
