2. The petitioner seeks regular bail in connection with Madhuban P.S. Case No. 290 of 2024 registered for the offence under Sections 238, 3(5) of the B.N.S. and Section 25, 9, 27 of the Arms Act.

3. As per the prosecution case, the informant alleged that on information that joy firing is being made in a marriage ceremony and upon reaching there, it was informed that while snatching of the arms, one Lucky Kumar has sustained gun shot injury and has been rushed to Patna for treatment. Upon inquiry, the relatives of Lucky Kumar did not give any satisfactory reply but the removal of blood stains from

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 27.09.2024.

5. Learned A.P.P. appearing for the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case, this application for regular bail is allowed.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Judicial Magistrate-1st Class, East Champaran, Motihari in connection with Madhuban P.S. Case No. 290 of 2024 subject to the following conditions:

(i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall appear before the concerned

(iv) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(v) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Sandeep Kumar, J) anand/- U T
