The petitioner is languishing in custody since 09.12.2018 in a case registered for the offences punishable under Sections 25(1-B)a, 26 and 35 of the Arms Act.

It is alleged that from the possession of the petitioner one country made pistol and several mobile phones were recovered. It is submitted by learned counsel for the petitioner that the investigation has already been concluded and the petitioner has remained under custody for more than five months. A statement has been made in paragraph no.3 of the petition that though the petitioner is involved in three other cases, but in those cases, he is on bail.

Learned APP submits that recovery has been made from

Considering the nature of recovery and period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul in connection with Supaul P.S. Case No. 698 of 2018.
