JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 401, 409, 413, 414, 420, 467, 468, 471/120B of the Indian Penal Code and u/s 30 of Arms Act. .

As per the prosecution case, on secret informant that one Pawan Shrivastava in collusion with staff of D.T.O. Muzaffarpur used to manufacture fake driving license, fake owner book, smart card and changes the new number of theft motor cycle, Bolero, and pick up van after punching and used to sell the same after omitting the Chassis and Engine No. a raid was conducted and this petitioner along with other accused persons were arrested on the spot and from where stolen vehicles were also recovered.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. No incriminating article has been recovered from the conscious possession of the petitioner and he is no way

It is submitted that thrust of accusation is against co-accused, Pawan Shrivastava, who used to sell the stolen vehicles after modifying Engine and Chassis number. On the alleged date of occurrence this petitioner had visited the garage in question for repair of his Activa scooter and unfortunately raid was conducted and this petitioner was arrested. Petitioner claims clean antecedent and is in custody since 16.01.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-II, West, Muzaffarpur in connection with Kanti PS case No. 50/2021.
