JUSTICE SHIVAJI PANDEY ORAL ORDER 03-03-2016 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. In this case, the petitioner is seeking anticipatory bail in connection with Balrampur P.S. Case No.123 of 2015, registered for the offence punishable under Sections 323, 325 and 376 of the Indian Penal Code and under Section 4 of the POCSO Act.
Allegation has been made that the petitioner gagged the victim and committed rape on her and when the victim started weeping he has given assurance that he will marry her. It has been alleged that the petitioner has committed rape on her on several occasions at different places and when she insisted for marriage, the petitioner started demanding motor-cycle and other articles.
Patna High Court Cr.Misc. No.9967 of 2016 (2) dt.03-03-2016 2/2 As it appears that the victim is 15 years of age, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected.
