JUSTICE SATYAVRAT VERMA ORAL ORDER 12-01-2022 Heard the learned counsel for the petitioner and the learned APP for the State through video conferencing. The petitioner seeks bail in connection with Town (Lohia Nagar) P. S. Case No.250 of 2021, instituted for the offences under Sections 452, 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
The learned counsel for the petitioner submits that the petitioner is in custody since 01.04.2021 and charge-sheet has been submitted in the case.
Allegation is of firing by the petitioner on the informant causing firearm injury on the waist of the informant. The learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. It was Krishna Sahni, who fired on the informant, on account of
Patna High Court CR. MISC. No.47002 of 2021(2) dt.12-01-2022 2/2 misunderstanding named the petitioner in the F.I.R. The learned A.P.P. for the State opposes the bail application and submits that the injury is grievous in nature caused by firearm and it is further submitted that the petitioner claims to be a politician and a social worker, but he has antecedent as mentioned in Para-3 of the petition. At this stage, the learned counsel for the petitioner seeks permission to withdraw the instant bail application with a liberty to renew his prayer for bail after framing of charge. Permission is accorded.
Accordingly, instant petition is dismissed as withdrawn with the liberty aforesaid.
