2. The petitioner apprehends his arrest in connection with Samastipur Muffasil P.S. Case No. 31 of 2025, registered for the offences punishable under Sections 109, 303(2), 324(4), 352 and 3(5) of the BNSS, 2023 and Section 27 of the Arms Act, 1959.

3. As per allegation, all the named accused persons including the petitioner and 4-5 unknown persons came at the informant's shop and started abusing and assaulting the informant. Upon protest, co-accused, namely, Abhishek Kumar opened fire.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The allegation is general and omnibus. Though, there is allegation of firing but the same is against the co-accused and moreso, none has suffered any kind of injuries. The case of the

No.37768 of 2025(2) dt.20-08-2025 2/2 petitioner is on exactly similar footing to that of co-accused Subham Kumar @ Samir Prakash Anand, who has been granted anticipatory bail by a co-ordinate Bench of this Court in Cr. Misc. No. 33674 of 2025. The petitioner is a person of clean antecedent.

5. On the other hand, learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances especially the clean antecedent of the petitioner, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-II, Samastipur in connection with Samastipur Muffasil P.S. Case No. 31 of 2025, subject to the conditions as laid down under Section 438(2) of the CrPC/482(2) of the BNSS, 2023. (Nawneet Kumar Pandey, J) Nirmal/- U T
