The petitioner has preferred this application for grant of regular bail in a case registered under sections sections 25(1) (1-AA), 25(1-B)(c), 26, 28 and 35 of the Arms Act . As per the prosecution case, on a raid being conducted arms and ammunitions were recovered from the house of accused Karpoori Tanti and on disclosure by him a raid was conducted in the house of the petitioner from where large number of articles meant for manufacture of illegal arms, details of which have been given in the FIR were recovered. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating material has been recovered from his possession.
Patna High Court CR. MISC. No.46780 of 2021(3) dt.04-03-2022 2/2 Some of the materials recovered were for the reason that the petitioner happens to be a blacksmith. He is in custody since 5.2.2021 and chargesheet has been submitted in the case. It is lastly submitted that the co-accused Karpoori Tanti has been enlarged on bail.
Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the allegations in the FIR together with the recovery of large number of materials meant for manufacture of illegal firearms from the house of the petitioner, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
