JUSTICE MUNGESHWAR SAHOO ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner, learned A.P.P. for the State and also learned counsel for the informant. Petitioner, namely, Manish Kumar Singh @ Manish Singh is in custody in Jamo Bazar P.S. Case No.87 of 2015 under Sections 341, 307, 506/34 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

From perusal of the F.I.R., it appears that the petitioner along with two co-accused persons named in the F.I.R. indiscriminately fired at the deceased husband of the informant who died during the treatment in the hospital after 1-2 days. Therefore, although in F.I.R. only section 307 I.P.C. was there subsequently section 302 I.P.C. was added.

In view of the allegation that there is indiscriminate
