====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------------- 15-12-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Natwar P.S. Case No.38 of 2014 registered under Section 392 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that on the basis of the written report of the informant, F.I.R. was registered under Section 392 of the Indian Pena Code against unknown. In course of investigation, the co-accused, Shahnaj Khan, who happens to be the brother-in-law of the petitioner, was apprehended by the police who confessed his guilt and stated that he had given the mobile to

Patna High Court Cr.Misc. No.56209 of 2015 (2) dt.15-12-2015 2/2 his sister, the wife of the petitioner, and the police also seized the said mobile from beneath the bed of the petitioner. Except that, there is nothing against the petitioner to connect him in the commission of the alleged offence. The petitioner is in custody since 25.08.2015.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Bikramganj, District-Rohtas, in connection with Natwar P.S. Case No.38 of 2014. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner.
