The petitioner apprehends his arrest in connection with Nimchak Bathani P.S. Case No. 15 of 2020 registered under Sections 147, 148, 149, 447, 323, 307, 354(A), 506 and 504 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. There is case and counter case (Annexure-2) between the parties. In the earlier dispute, brother of the petitioner had also sustained injury on the head, as contained in Annexure-3 to the bail application. Further he submits that it is evident from Annexure-4 that the fardbeyan which is recorded in Patna is totally different than the manner of
Patna High Court CR. MISC. No.46869 of 2021(9) dt.06-04-2023 2/2 occurrence and place of occurrence disclosed in the first information report.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-X, Gaya in connection with Bathani P.S.
