JUSTICE SHIVAJI PANDEY ORAL ORDER 05-02-2016 Heard learned counsel for the petitioner and learned counsel for the State.
In this case, the petitioner is seeking regular bail in connection with Sessions Trial No.1406 of 2013, arising out of Dhanarua P.S. Case No.66 of 2013, registered for the offence under Section 304(B)/34 of the Indian Penal Code. The allegation has been made against the petitioner to put his wife to death.
From the record, it appears that out of 13 witnesses 4 witnesses have been examined.
In such view of the matter, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, the Trial Court is directed to ensure the
Patna High Court Cr.Misc. No.56647 of 2015 (4) dt.05-02-2016 2/2 production of the rest witnesses and conclude the trial as early as possible preferably within a period of nine months. The prosecution side is also directed to produce left out witnesses so that trial may be completed within the aforesaid period. If the trial is not concluded within the stipulated period, the petitioner will have a liberty to renew his prayer for bail.
