JUSTICE SANJAY PRIYA ORAL ORDER 3/ 23-07-2019 Heard learned counsel for the petitioner and learned APP for the State as well as counsel for informant. Petitioner seeks bail in Jurawanpur P.S. Case No.25 of 2019 instituted for the offence under Section(s) 448, 379, 376, 511, 506/34 Indian Penal Code.

Counsel for the petitioner submits that petitioner and the informant are co-villagers. Petitioner has been implicated in this case due to village politics.

In the written report, it is alleged that on the date of occurrence this petitioner along with co-accused, Rudal Rai, tried to misbehave with daughter of the informant. No age of the victim has been mentioned in the written report. Statement of the victim under Section 164

Patna High Court CR. MISC. No.36234 of 2019(3) dt.23-07-2019 2/2 Cr.P.C. has not been recorded.

Counsel for the informant has opposed prayer for bail. Petitioner is in custody since 15.03.2019.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VIII, Vaishali at Hajipur, in connection with Jurawanpur P.S.
