2. The petitioner seeks bail in connection with Rosera P.S. Case No. 291 of 2024 dated 27.11.2024 registered for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 352, 351(2) of Bharatiya Nyay Sanhita, 2023 and Section 27 of the Arms Act.

3. The prosecution case, in short, is that on the date of occurrence all the accused persons including the petitioner went at the house of the informant and started abusing and on protest, they started firing while one co-accused Kundan Kumar shot upon the stomach of informant's husband due to which he fell down and blood started oozing out. Thereafter, all the accused persons fled away.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that there is specific allegation against the coaccused Kundan Kumar, who is son of the petitioner. There is no specific allegation against the petitioner, rather, the allegation against him is general and omnibus. Lastly, it has been submitted that the petitioner is in custody since 28.11.2024, having one criminal case against him and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Rosera, Samastipur in connection with Rosera P.S.
