The petitioner, namely, Nishant Kumar @ Annu, is in custody in Gopalganj P.S. Case No. 279 of 2011(G.R. No.2622 of 2011) under Sections 366, 366A of the Indian Penal Code. The prosecution case is that the informant lodged an F.I.R. alleging that his minor daughter has been kidnapped by this petitioner and two others and they might have raped her. The statement of the victim girl has been recorded under Section 164 of the Cr.P.C. She has fully supported the case of kidnapping and commission of rape by this petitioner and two others, therefore, I am not inclined to grant bail to this petitioner.
