ANJANA MISHRA ORAL ORDER 20-05-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 363/365/ added Section 364/302/201/34 of the Indian Penal Code. Learned counsel for the petitioners submits that though not named in the First Information Report, the petitioners are suspected to be involved in the killing of the deceased. It is further submitted that save and except the suspicion, there is no further material in the case dairy to implicate the present petitioners. Learned counsel for the State after perusal of the case dairy submits that there is no cogent material to implicate the present

Patna High Court Cr.Misc. No.9631 of 2016 (3) dt.20-05-2016 petitioners except the suspicion raised against them as it was suspected that petitioner no. 2 was having an illicit relation with the deceased.

In view of the aforementioned facts and circumstances and that the petitioners have no criminal antecedent, let the petitioners, in the event of their arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand)each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Gopalpur (Rangra) P.S. Case No. 402 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
