The petitioner is accused in connection with Arwal P.S. Case No. 211 of 2015, registered under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that it would appear from F.I.R. regarding theft of the vehicle in question in the night of 06.09.2015, an F.I.R. was lodged on 07.09.2015 at about 6.30 A.M. at Police Station, Arwal District, whereas seizure-list of the vehicle in question shows that the said vehicle was seized from Govindpur at Dhanbad at 10.30 hours on which Arwal A.S.I. has also put his signature. The seizure of the vehicle is said to be signed by

Patna High Court Cr.Misc. No.55175 of 2015 (3) dt.30-01-2016 petitioner and one Pankaj Kumar. Further submission is that in fact the Police remanded the petitioner and co-accused Pankaj Kumar showing the recovery of vehicle in question from their possession, which was found abandoned. Moreover co-accused Pankaj Kumar has already been granted bail vide order dated 16.12.2015 passed in Criminal Miscellaneous No. 52980 of 2015 and this petitioner is in custody since 08.09.2015. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal in connection with Arwal P.S. Case no. 211 of 2015.
