JUSTICE MUNGESHWAR SAHOO ORAL ORDER 18-12-2015 Heard the learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner, namely, Jitendra Ram is in custody in Sessions Trial No.437 of 2015 arising out of Bettiah Muffasil(Banuchhapar) P.S. Case No.547 of 2014 under Sections 302, 201/34 of the Indian Penal Code.

The learned counsel for the petitioner submitted that in similarly situated case, the two co-accused persons have already been granted bail by this Court in Cr. Misc. No.37814 of 2015 and 25968 of 2015 on 26.08.2015 and 23.07.2015 respectively. Perused the F.I.R. It appears that only on suspicion, the petitioner and co-accused persons have been named and in

Patna High Court Cr.Misc. No.55848 of 2015 (2) dt.18-12-2015 similarly situated case, two co-accused persons have already been granted bail.

Considering the above facts, I direct the petitioner named above to be released on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-3rd, Bettiah, District - West Champaran in connection with Sessions Trial No.437 of 2015 arising out of Bettiah Muffasil(Banuchhapar) P.S.
