Earlier the bail application of the petitioner was rejected vide detailed order dated 20.11.2019 passed in Cr. Misc. No. 53123 of 2019.

The petitioner seeks bail in connection with Chowk P.S. Case No. 229 of 2019 registered for the offence punishable under Sections 376, 506 of the Indian Penal Code and 67 (A) of I.T. Act. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and has not committed any offence as alleged in the FIR. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. Learned counsel for the petitioner has filed supplementary affidavit stating therein that the statement of the victim girl was recorded

Patna High Court CR. MISC. No.47152 of 2021(4) dt.22-09-2021 2/2 before the learned Trial Court on 07.09.2021 and she has not supported the prosecution case. The petitioner has no criminal antecedentas has been mentioned in para 3 of this bail application and he is languishing in custody since 25.06.2019. Learned APP for the State opposed the bail petition. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor court in connection with Chowk P.S. Case No. 229 of 2019.
