JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased and is languishing in jail custody since 10.08.2015 in a case registered under section 304B/34 of the Indian Penal Code. The marriage of deceased had taken place with petitioner in the year 2010 and according to the prosecution case itself, the deceased consumed poison on 7.06.2015 i.e near about after five years of her marriage. Furthermore, it is also an admitted case of the prosecution that deceased died on 21.06.2015 and after her death, the present case was lodged. Furthemore, it is also an admitted case of the prosecution that deceased was taken to

Patna High Court Cr.Misc. No.237 of 2016 (2) dt.05-01-2016 2/2 hospital by the petitioner and his other family members and when the informant came at the hospital on 7.06.2015, petitioner and his family members were found present in the hospital. It is also an admitted case of the prosecution that deceased was issuless lady and her treatment was got done by her in-laws. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Supaul in connection with Birpur ( Balua) P.S.Case No. 118 of 2015.
