The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 302 of the Indian Penal Code. The prosecution case is that the father of the informant was found lying in newly constructed house in the injured condition, when he was taken to Sadar Hospital, the injured was referred to D.M.C.H. and again to P.M.C.H. but ultimately admitted to Novel Emergency Hospital, Kankarbagh, Patna where he was declared dead. The petitioner was not named in the First Information Report but suspicion was raised since the victim made the last call to this petitioner with whom there was some

It is submitted by the learned counsel for the petitioner that only on suspicion the accusation has been levelled.

It is submitted by the learned counsel for the informant that process under Sections 82 and 83 Cr.P.C. have been issued.

Considering the fact that process under Sections 82 and 83 have been issue, this Court is not inclined to interfere.

Let the learned court below consider the prayer for regular bail of the petitioner keeping in view that only suspicious nature of accusation has been levelled against the petitioner in connection with Madhubani (Town) P.S. Case No. 358 of 2015, pending in the court of learned Chief Judicial Magistrate, Madhubani.

With the above observation this application is disposed of.
