Petitioner apprehends his arrest in a case under section 304B/201/34 of Indian Penal Code.
The allegation is that the accused persons including the petitioner killed the informant's daughter for non-fulfillment of dowry demand.
Learned counsel for the petitioner submits that in fact the relationship between the petitioner and the deceased was cordial and they had two children from the wedlock also. The girl died due to diarrhea and she was taken to the local Nursing Home for her treatment.
In view of nature of allegations and also taking into
Patna High Court Cr.Misc. No.8446 of 2016 (2) dt.11-04-2016 2/2 consideration that the petitioner is the husband of the deceased, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is refused with direction to surrender and seek regular bail which would be disposed of on its own merit without prejudice, preferably on the same day.
