Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 428, 429, 279, 307, 414 and 120(B) of the Indian Penal Code and Sections 11(i), (d) and (e) of the Animal Cruelty Act, 1960, registered in connection with Kutumba P.S.Case No. 56 of 2021.
As per allegation, the cattle on some vehicles were recovered that were being carried for slaughter. The learned counsel for the petitioner has submitted
Patna High Court CR. MISC. No.47046 of 2021(2) dt.16-05-2022 2/2 that the petitioner is innocent and he is a bona fide owner of the vehicles. He has submitted further that the petitioner is a person of clean antecedents.
Considering the above facts and circumstances, especially the clean antecedents of the petitioner, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Kutumba P.S.Case No. 56 of 2021 (G.R.No.524 of 2021), subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
