The petitioners are apprehending their arrest in Ishakchak P.S. Case No. 150 of 2019 registered under Sections 406, 420, 379, 120(B) and 34 of the Indian Penal Code.

Prosecution allegation is of taking money by cheating to the tune of Rs. 77.5 lakhs.

It has been submitted on behalf of the petitioners that the petitioner Nos. 1 & 3 have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. For oblique reasons, the petitioners have been made accused in the present case. The informant and the accused persons are police constables in police station posted at Bhagalpur. The petitioner No. 1 is a lady. The allegation of transaction of money between the constables is alleged against the co-accused namely Sunil Kumar. The petitioner Nos. 1, 2 & 3 are mother, brother and brother-in-law of said Sunil Kumar. On behalf of the State, it is submitted that the petitioners are not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances of the case, the petitioners, above named, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, be released on anticipatory bail on

No.46759 of 2021(2) dt.12-04-2022 3/3 furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 150 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
