The petitioner, namely, Sikandar Sahani, is in custody in Kesariya P.S. Case No. 260 of 2015 under Sections 25(1-b)A, 26 of the Arms Act.

Learned counsel for the petitioner submitted that from conscious possession of the petitioner, nothing has been recovered and the petitioner has been falsely implicated in this case. On the other hand, learned A.P.P. has opposed the prayer for bail.

Considering the nature of allegation and the fact that the one country-made pistol loaded with one cartridge and that the petitioner is in custody since 29.09.2015, I direct the petitioner, named above, to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.55718 of 2015 (2) dt.16-12-2015 bond of Rs.5,000/- (Five Thousand Rupees) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Kesasriya P.S. Case No. 260 of 2015.
