JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although, it is stated that petitioner demanded extortion money and when his demand was not fulfilled, he gave dagger blow to informant and it is also alleged that prior to the alleged occurrence he had committed similar occurrence for which he was sent to jail custody but submission on behalf of the petitioner is that informant has sustained simple injury and moreover, the case has already been compromised between the parties. It is further contended by him that alleged occurrence took place on account of petty dispute and as a matter of fact, the allegation of demand of extortion money is false and concocted with an intent to make the offence graver.

Considering the aforesaid facts and circumstances as

No.57063 of 2015 (2) dt.18-12-2015 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Town P.S. Case No. 170 of 2015.
