Petitioner, namely, Uday Kumar is in custody since 30.10.2015 in Rajgir P.S. Case No.122 of 2015 under Sections 302, 201 and 379/34 of the Indian Penal Code. The learned counsel for the petitioner submitted that this is a case of last seen and the other co-accused persons whose cases are on same footing have already been released on bail by this Court in Cr.Misc.No.44228 of 2015 and Cr.Misc.No.48247 of 2015. According to the learned counsel for the petitioner, the case of this petitioner is on same footing.

In view of the above fact that the co-accused persons,

Patna High Court Cr.Misc. No.55817 of 2015 (2) dt.18-12-2015 whose cases are on same footing have already been released on bail, I direct that the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/-(Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nalanda in connection with Rajgir P.S. Case No.122 of 2015.
