The petitioner wants to renew his prayer for bail which was earlier rejected by the order dated 04.03.2015 passed in Cr. Misc. No. 44518 of 2014 disposed of along with Cr. Misc. No. 44194 of 2014 and 51405 of 2014 on the ground that the petitioner is in custody since 18.06.2014, up till now not even a single prosecution witness has been examined and as such he deserves sympathetic consideration, to which the learned A.P.P. opposes. Considering that in the test identification parade the driver of the vehicle has identified the petitioner and as such finding no good ground for reconsideration of prayer for bail of

Patna High Court Cr.Misc. No.57704 of 2015 (3) dt.03-03-2016 2/2 the petitioner, again prayer for bail of the petitioner stands rejected in connection with Motihari Town P.S. Case No. 284 of 2014 pending in the court of the Chief Judicial Magistrate, East Champaran, Motihari.

However, the trial court is directed to expedite the trial and to conclude the same preferably within six months after keeping the same on the day to day basis, failing which the petitioner may be at liberty to renew his prayer for bail. (Jitendra Mohan Sharma, J) Abhay/- U T
