JUSTICE RAKESH KUMAR ORAL ORDER 18-12-2015 Heard Sri Vishwa Ranjan Chaudhary, learned counsel for the petitioner, Sri Sadanand Paswan, learned Special Public Prosecutor as well as Sri Hirday Prasad Singh, learned counsel who has voluntarily appeared on behalf of the informant. The petitioner who is in custody in connection with Nardiganj P.S. Case No. 41 of 2015 registered for the offence under Section 302 /34 of the Indian Penal Code , Section 27 of the Arms Act and Section 3(ii)(v) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities ) Act, 1989 has prayed for grant of bail.

Learned counsel for the petitioner submits that of - course in the F.I.R. the informant has alleged that she had seen the petitioner and his two brothers fleeing away after committing

Patna High Court Cr.Misc. No.55365 of 2015 (2) dt.18-12-2015 2/2 the crime with arms, it has not been alleged as to who has fired. In view of the nature of accusation, I am not inclined to extend the privilege of bail to the petitioner. The petition stands dismissed.
