This application for grant of anticipatory bail arises out of Makhdumpur P.S.Case No. 94/2015, disclosing offences under sections 419, 420, 409/34 of the Indian Penal Code. Learned Senior counsel, appearing on behalf of the petitioner, has submitted that at the relevant point of time, the petitioner was working as Gram Sevak, Gram Panchayat, Kanchanwa, in the District of Jehanabad. In the First Information Report the petitioner was not named, whereas Mukhiya of the Gram Panchayat, namely, Ashok Kumar and the son Niranjan Kumar have been made accused for committing financial irregularities in handling funds of various Schemes. He submits
Patna High Court Cr.Misc. No.7818 of 2016 (2) dt.04-04-2016 that the said Ashok Kumar and Niranjan Kumar have been granted either regular bail or anticipatory bail by this Court. He has referred to the order dated 5.10.2015 passed in Cr.Misc.No. 41251/2015 and the order dated 14.10.2015 passed in Cr.Misc.No. 44303/2015. He further submits that considering the nature of allegation, there is no chance that the petitioner will tamper with the evidence or influence the investigation.
Considering the above, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad in Makhdumpur P.S.Case No. 94/2015, subject to the conditions as laid down under section 438(2) of the Cr.P.C. This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
