JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Patliputra P.S. Case No. 17 of 2020 registered for the offences punishable under Sections 365, 120B and 34 of the Indian Penal Code, 1860, later converted into Sections 364A, 120B, 379 and 34 of the Indian Penal Code during investigation. The father of the victim is the informant, who has alleged in the F.I.R. that his son had gone with his friends and subsequently he was kidnapped from Patna on 09.01.2020. The victim was subsequently recovered from Motihari. The victim, in his statement recorded under Section 164 of the Cr.P.C. gave
Patna High Court CR. MISC. No.33996 of 2020(5) dt.19-02-2021 2/2 vivid descriptions of the manner in which he was kidnapped by the miscreants including this petitioner allegedly for the purpose of trade of 'human organs'.
It appears that in similar circumstance other coaccused persons namely Ankit Kumar @ Sarkar and Prince Kumar @ Kamal Kumar Pandey have been refused prayer for grant of regular bail.
Considering the gravity of the offence and nature of accusation, I am not inclined to grant the petitioner privilege of regular bail for the present.
If, however, no charge is framed within six months from today, the petitioner shall be at liberty to renew his prayer for bail.
