JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 27-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has renewed his prayer for bail in connection with Fulwariya P. S. Case No. 60 of 2014. The prayer for bail of the petitioner was earlier rejected by this Court vide order dated 21.11.2014 with an observation that if the trial is not concluded within nine months from the date of receipt/production of a copy of the order, the petitioner would be at liberty to renew his prayer for bail.

Learned counsel for the petitioner has fairly conceded that till date neither the order passed by this Court has been communicated to the Court below nor a copy of the order has

Patna High Court Cr.Misc. No.234 of 2016 (2) dt.27-01-2016 2/2 been produced in the Court. He has also fairly submitted that out of five charge-sheet witnesses, four have already been examined during trial.

Taking into consideration the advance stage of the trial, I am not inclined to review the earlier order. Accordingly, the prayer for grant of bail to the petitioner is rejected. The Court below is directed to expedite the trial and conclude the same as early as possible.
