====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------- 03-02-2016 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in connection with Tarari P.S. Case No.66 of 2015 registered under Sections 448 and 354/34 of the Indian Penal Code besides Sections 3(i)(x) of the SC/ST Act. The accusation is that both the petitioners entered the house of the informant, Shobha Kumari, aged about 18 years where she alongwith her mother and sister was sleeping. At that time, both the petitioners took the Dupatta of the informant and tried to outrage her modesty but on hulla being raised by her, the family members of the informant woke up and both the petitioners were caught by the villagers and handed over to the police.

No.55385 of 2015 (3) dt.03-02-2016 2/2 Learned counsel appearing on behalf of the petitioners submits that, in fact, both the petitioners are the resident of Barap under the Police Station, Agiaon (Garahni), and due to business dispute with the father of the informant, who was not at the house on the alleged date and time of the occurrence, the informant has falsely implicated these petitioners. Further submission is that the petitioners having no criminal antecedents are in custody since 12.09.2015.

Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arrah, in connection with Tarari P.S. Case No.66 of 2015.
