Petitioner is in custody in connection with G.O. Case No. 367 of 2019 arising out of L.N.M.U. P.S. Case No. 94 of 2019 for the offence under section 30(a) of the Bihar Prohibition and Excise Act and Section 272, 273 and 34 of the Indian Penal Code.

Learned counsel for the petitioner would submit that petitioner has no criminal antecedent.

In the instant case total 67 liters of nepali wine was seized.
