The petitioner has renewed his prayer for anticipatory bail which was earlier rejected by a coordinate Bench of this Court vide order dated 21.12.2021 passed in Cr. Misc. No. 48328 of 2021 who is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 504, 506, 379, 307 of the Indian Penal Code.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.37328 of 2022(2) dt.30-11-2022 2/3 petitioner that there is counter version of the occurrence also and petitioner's side also sustained injuries. Moreover, good sense has prevailed between the parties and both the parties have compromised the matter. A copy of the compromise petition is annexed as Annexure-5 to the petition.
No new ground has been raised by the learned counsel for the petitioner to take a different view in the matter.
Considering the fact that by order dated 21.12.2021 passed vide Cr. Misc. No. 48328 of 2021, the prayer for grant of anticipatory bail has already been rejected by a coordinate Bench of this Court, this Court is not inclined to take a different view in the matter. The prayer for grant of anticipatory bail to the petitioner stands rejected.
Let learned Court below consider the regular bail of the petitioner, keeping in view the facts stated above, in accordance with law without being prejudiced
Patna High Court CR. MISC. No.37328 of 2022(2) dt.30-11-2022 3/3 by the order of this Court, if he surrenders within a period of four weeks from today and pray for regular bail.
