JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 07-12-2016 Seen the report submitted by the learned lower court as well as by the Superintendent of Police, Saran at Chapra. At an earlier occasion, vide Annexure-1, prayer of the petitioner for bail was rejected.

From the report submitted by the learned lower court, it is evident that after closure of the prosecution case, date was fixed for examination of accused under Section 313 of the Cr.P.C.. However, at that very stage, a prayer was made on behalf of accused in terms of Section 311 of the Cr.P.C. which has been rejected by the learned lower court against which, as has been submitted by the learned counsel for the petitioner, Cr. Misc. has been filed before this Court.

In the aforesaid facts and circumstances of the case, there appears to be no scope for reconsideration of the prayer. Consequent thereupon, prayer for bail is rejected. (Aditya Kumar Trivedi, J) perwez U T
